Criminal Sexual Conduct Charges in Michigan: What You’re Facing

Michigan organizes criminal sexual conduct into four degrees under MCL 750.520b through MCL 750.520e. Each degree is defined by the nature of the conduct and the circumstances surrounding it. A conviction at any degree reaches beyond incarceration. Consequences include registration as a sex offender under the Michigan Sex Offender Registration Act (SORA), lifetime GPS electronic monitoring in some cases, mandatory HIV and STD testing, and lasting collateral effects on employment, housing, and immigration status. These aren’t hypothetical consequences. They attach automatically to most CSC convictions.

First Degree Criminal Sexual Conduct (CSC 1)

First Degree Criminal Sexual Conduct under MCL 750.520b is the most severe charge in Michigan’s CSC framework. It carries a possible sentence of life in prison without parole, a possible mandatory minimum of 25 years, consecutive sentencing, and lifetime GPS electronic monitoring. A conviction also results in Tier 3 SORA registration, meaning lifetime public registration with quarterly reporting requirements.

SORA registration is Tier 2 or Tier 3 depending on the circumstances, meaning 25 years of public registration with semiannual reporting (Tier 2), or lifetime public registration with quarterly reporting (Tier 3). A conviction still carries consequences that can follow you permanently.
