Dedicated to Defending Sex Crimes Countless Cases Won Based on Our Refusal to Lose

Sexual Assault Attorney in Michigan

Not Guilty Verdicts Across All Four CSC Degrees. 100% Devoted to the Accused.

In Michigan, criminal charges for sexual assault are filed under the Criminal Sexual Conduct (CSC) framework, not under a statute called “sexual assault.” If you’re searching for a sexual assault lawyer in Michigan, you’re likely facing a CSC charge or a police investigation, and the distinction matters for how your defense is built. At Prain Law, PLLC, we handle all four degrees of Criminal Sexual Conduct and devote 100% of our practice to defending the criminally accused.

Founding attorney Brian J. Prain has obtained Not Guilty verdicts across CSC 1st, 2nd, 3rd, and 4th Degree cases, including a combined CSC 1st Degree, Torture, Strangulation, and Felonious Assault matter in Oakland County Circuit Court. These are past results and don’t guarantee any outcome in your case, but they reflect a trial-first commitment that distinguishes our representation. We serve clients throughout Michigan, including the metro Detroit area.

An accusation alone, before any formal charge is filed, is the right time to call us. Don’t speak with investigators first. Contact Prain Law, PLLC at (248) 731-4543 for a free consultation.

What a CSC Conviction Means Beyond Prison Time

The sentence is only part of what’s at stake. A Criminal Sexual Conduct conviction in Michigan carries mandatory placement on the Michigan sex offender registry, which is publicly accessible. For CSC-I, registration is for life, along with lifetime electronic monitoring. For CSC-II, lifetime registration and monitoring apply when the offender was 17 or older and the victim was under 13; other CSC-II convictions carry different registration periods. These consequences follow a person into employment, professional licensing, housing, and personal relationships long after any prison term ends.

Fields including medicine, law, and education have licensing boards that act on criminal convictions independently of the courts. A CSC charge can trigger professional consequences before a case is resolved. For individuals currently under investigation who haven’t been charged yet, the decisions made in those early days, including whether to speak with police, can shape everything that follows.

How Prain Law, PLLC Defends Sexual Assault Charges in Michigan

Brian J. Prain devotes his practice entirely to trying criminal cases before Michigan juries. Every case gets a defense built around its specific facts. That means a thorough review of law enforcement procedures, forensic and physical evidence, and the accuser’s statements from the outset.

Using the Preliminary Examination as a Defense Tool

In Michigan CSC cases, the preliminary examination is a strategic moment. When a defendant asserts that right, the accuser must testify under oath before trial. We use that opportunity to assess credibility and lock in testimony early. We’re also familiar with the procedural landscape specific to these cases, including the Rape Shield Law, the corroboration standards under MCL 750.520h, and the process for challenging prior false allegations through an in-camera hearing.

From Investigation Through Trial

We handle cases through trial, plea negotiation, and, where the facts support it, dismissal. Our allegiance is to the accused, and we don’t back down when the stakes are high.
